Terms and conditions

1. Introduction

These Terms of Use govern your access to and use of our Moodle e-learning platform, including all content, features, and services provided through the site. By accessing or using the Service, you agree to be bound by these Terms which include a Privacy Policy and a Refund Policy. If you do not agree to these Terms, you may not use the Service.

2. Acceptance of Terms

By registering for an account, logging in, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. These Terms constitute a legally binding agreement between you and Pro Talent cc. We may update these Terms from time to time, and your continued use of the Service after any such changes constitutes your acceptance of the revised Terms.

3. User Accounts

To access learning material, you must register for an account. You agree to:

•Provide accurate, current, and complete information during the registration process.

•Maintain the security of your password and identification.

•Be solely responsible for all activities that occur under your account.

•Notify us immediately of any unauthorized use of your account or any other breach of security.

Your account is for your exclusive use only and may not be shared with others. Sharing your account credentials may result in immediate termination of your access to the Service.

4. User Conduct

You agree to use the Service only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Service.

5. Intellectual Property

All content and materials available on the Service are the intellectual property of Pro Talent or any other party such as academic institutions, authors, institutes, journals, etc as referenced or quoted in the learning material. As registered user you can enjoy access and use the content for your personal, non-commercial self-development purposes only.

Any content you upload, post, or submit to the Service remains your intellectual property. However, by submitting content, you grant Pro Talent a worldwide, non-exclusive, royalty-free license to use such content in connection with the Service.

6. Privacy Policy

Your privacy is important to us.

• We collect minimum personal details when you sign up, such as your name, email address and ID number for learner identification purposes
• When you use our site, we may automatically collect technical data to ensure our site works properly. We also use cookies to enhance your experience and improve our service. 

We use your information to provide and improve our e-learning services, and to keep a record of your learner achievements and your account. Such information may be shared with organizations that sponsor your subscriptions or your professional bodies who may need confirmation of training credits for CPD point allocations.

By using the Service, you consent to our collection and use of your data as described above.

Access to your information is password protected, over which you have full control.

7. Disclaimers and Limitation of Liability

The Service is provided on an "as is" and "as available" basis. Pro Talent makes no warranties, express or implied, regarding the operation or availability of the Service or the content included therein.

Pro Talent will not be liable for any damages of any kind arising from the use of the Service, including, but not limited to direct, indirect, incidental, punitive, and consequential damages.

8. Termination and refunding policy

We reserve the right to terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

If you fail to renew your subscription, your account will be suspended until you provide us with proof of payment.

If you want to opt out of a subscription, or enrolment in a course, you must submit your request to admin@protalent.co.za within 3 days to receive full refunds. If you have claimed any training credits or certificates during this time, you forfeit the right to any refunds.

9. Accreditation and Certification

Through its Academy for Practical Leadership Development, Pro Talent offers a series of personal and leadership development courses on the e-learning platform. It is developed to serve identified business needs and consists of research results, reading material, and a variety of people development interventions such as simulations and self-reflection exercises which do not fall under the ambit of typical occupational training. It is not designed to lead to an occupational qualification. It is all about people-development which falls within the ambit of Industrial and Organizational Psychology. Therefore, our accreditation is through the Professional Board for Psychology, within the Statutory Body, Health Professions Council of South Africa. HPCSA regulates the registration of an individual practitioner and the practitioner’s practice (Pro Talent cc in our case) is then mandated to offer professional services, like the self-development courses on our platform.

Learners can earn a Certificate of Achievement on successful completion of courses.

Our short courses are ideally suited for Continuing Professional Development purposes, and some courses are accredited by some professional bodies as indicated on the course pages.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of South Africa.
